Two questions decide everything

Is your existing MOT still valid? Testing early is common, and days left on the old certificate change the answer.

Was the failure recorded as dangerous? The tester grades each defect, and “dangerous” is a specific category meaning an immediate risk to road safety.

Together: a dangerous defect means the car must not be driven at all until repaired, valid certificate or not. A major defect with a still-valid MOT means you may legally drive it away — though whether you should is a different question.

Driving without a valid MOT

There is one narrow exemption: you may drive to a pre-arranged repair appointment or a booked MOT test. Pre-arranged is the operative word — an actual booking, not an intention to find a garage.

That exemption does not rescue a dangerous defect. A car with failed brakes is not made safe by having an appointment.

The “major fail, still legal” trap

Legal is not the same as sensible. If a car has just been failed for corroded brake pipes or a worn suspension component, and that then contributes to a collision, being technically within the law while knowingly driving something a tester had just failed is not a comfortable position with an insurer.

A short drive to a booked repair: reasonable. Carrying on using it for a fortnight until the work is affordable: not.

What usually fails

Lighting and signalling, tyres, suspension, brakes and driver visibility make up the large majority. The first two are the biggest share and both take five minutes to check at home — a walk round the lights and a tread check is the cheapest MOT preparation there is.

Also worth doing first: top up the screenwash, clear the boot so the tester can get to things, check the plate is legible and the wipers do not smear.

Keeping your free retest

If you leave the vehicle at the test centre for repair, or bring it back within ten working days, a partial retest is normally free or reduced. Driving it away can forfeit that. Ask before you collect it — it is a common and avoidable extra cost.

Getting it moved

If the fail was dangerous, the car needs transporting rather than driving. Tell us what the defect is when you call — failed brakes, insecure suspension or a seized wheel each change how it is loaded.

Can I drive my car away if it failed its MOT?

It depends on two things: whether your existing MOT is still valid, and whether the failure was recorded as dangerous.
